New Waste Transfer and Consignment Note requirements
The Waste (England and Wales) Regulations 2011 applied the requirement for Waste Transfer Notes and Consignment Notes to include a statement relating to the Waste Hierarchy. When signing a Note, Transferrors/consignors are stating that they have 'fulfilled their duty' to apply the Waste Hierarchy ie to ensure that they have used the highest level of Prevention, prepare for reuse, recycling, recovery and landfill disposal.
How this will be enforced has not yet been made clear, but in England and Wales all Transfer and Consignment Notes must, from 28th September, contain the statement 'I confirm that I have fulfilled my duty to apply the waste hierarchy as required by Regulation 12 of the Waste (England and Wales) Regulations 2011.'
The Regulations heralded two other changes, both relevant from the same date.
- Transfer Notes now require a SIC 2007 code for the transferror. Both this and the Statement must be applied to any new Transfer Notes issued from 28th September, but the EA have stated that any annual Transfer Notes issued before that date under the old format remain valid until renewal.
- Consignment Notes now use the same format for both single and multiple collections. The EA issued template includes a new box for multiple collections and the old multiple collection note can no longer be used.
The requirement for the SIC 2007 code on Transfer Notes has caused some consternation amongst waste producers, many of whom have now been contacted by their waste management companies with a new WTN to complete.
